Qistiq Advance Cash Advance Agreement

Effective Date: January 1, 2025

This Cash Advance Agreement ("Agreement") is entered into between Qistiq Advance ("Qistiq," "Company," "we," "our," or "us") and the individual identified below ("Borrower," "Customer," "you," or "your").

3. Purpose of Agreement

This Agreement governs the cash advance provided by Qistiq to the Borrower and establishes the Borrower's repayment obligations. Approval of any advance is solely at the discretion of Qistiq and may be based on identity verification, risk assessment, income verification, repayment history, fraud screening, and other factors.

4. Borrower's Promise to Repay

The Borrower unconditionally agrees to repay the Total Repayment Amount stated in this Agreement on or before the Repayment Date. The Borrower acknowledges that acceptance of the advance creates a legally binding obligation to repay the amount owed.

5. Payment Authorization

The Borrower authorizes Qistiq to collect repayment using the selected payment method where permitted by applicable law. Authorized payment methods include ACH, Debit Card, InstaPay, Bank Transfer, and Mobile Wallets depending on region.

6. Early Repayment

The Borrower may repay the advance before the repayment date. Unless otherwise disclosed, early repayment does not create any obligation for Qistiq to provide refunds of service fees already earned or disclosed.

7. Missed Payments

If payment is not successfully received by the repayment date, Qistiq may send payment reminders, restrict account access, suspend future advance eligibility, request updated payment information, and exercise other rights permitted by law.

8. Default

The Borrower may be considered in default if payment is not received by the due date, the Borrower provides false information, fraudulent documents are submitted, identity theft or fraud is detected, or the Borrower violates this Agreement.

Upon default, Qistiq may pursue lawful remedies available under applicable law.

9. Fraud and Misrepresentation

The Borrower certifies that all information provided is true, accurate, and complete and agrees not to submit false documents, use another person's identity, misrepresent employment or income, create duplicate accounts, or attempt to bypass risk controls.

Fraud may result in immediate account closure and legal action where permitted by law.

10. Electronic Communications

The Borrower agrees to receive communications electronically including advance approvals, repayment reminders, security notices, legal notices, and account updates.

11. Electronic Signature Consent

The Borrower agrees that electronic signatures are legally binding, electronic records may replace paper records, and clicking "Sign & Accept" constitutes execution of this Agreement.

12. Collection Activities

If repayment remains outstanding, Qistiq may engage in collection efforts consistent with applicable law including payment reminders, communications, internal collections review, and external collection services where legally permitted.

13. User Representations

The Borrower represents that they are at least 18 years old, have legal authority to enter this Agreement, the information provided is accurate, they understand the repayment obligation, and they are not using the advance for unlawful purposes.

14. No Guarantee of Future Advances

Approval of one advance does not guarantee approval of future advances. Qistiq may increase limits, reduce limits, suspend eligibility, or modify approval criteria at its sole discretion and subject to applicable law.

15. Limitation of Liability

To the fullest extent permitted by law, Qistiq shall not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of its services.

16. Governing Law

This Agreement shall be governed by applicable laws and regulations governing the services provided in the user's jurisdiction.

17. Entire Agreement

This Agreement, together with the Terms and Conditions, Privacy Policy, Payment Authorization Agreement, Electronic Signature Consent, and related disclosures, constitutes the entire agreement between the parties.

Customer Acknowledgment

By using Qistiq services, you acknowledge that:

The Borrower has read this Agreement.
The Borrower understands the repayment obligation.
The Borrower agrees to repay the advance.
The Borrower consents to electronic communications.
The Borrower authorizes repayment collection.
The Borrower understands the consequences of non-payment.
