Qistiq Advance Electronic Signature and Electronic Records Consent
Effective Date: January 1, 2025
This Electronic Signature and Electronic Records Consent ("E-Sign Consent") is entered into between Qistiq Advance and the individual using the Qistiq platform.
1. Purpose
This Consent allows Qistiq to provide records, disclosures, notices, agreements, communications, and other documents electronically instead of paper documents. This Consent applies to Terms and Conditions, Privacy Policy, Cash Advance Agreements, Payment Authorization Agreements, Fee Disclosures, Collection Notices, Customer Communications, Legal Notices, Repayment Notices, and future agreements and disclosures.
2. Electronic Signature Consent
You agree that your electronic signature has the same legal effect as a handwritten signature to the maximum extent permitted by applicable law. Electronic signatures may include clicking "Sign & Accept", clicking "I Agree", checking acceptance boxes, typing your name, entering a verification code, using biometric authentication where available, or any electronic action indicating acceptance.
These actions constitute your legally binding signature.
3. Consent to Electronic Records
You agree that Qistiq may provide documents electronically including agreements, statements, policies, disclosures, payment confirmations, collection notices, account notifications, and regulatory notices.
Electronic delivery satisfies any requirement that such communications be provided in writing where permitted by law.
4. Delivery Methods
Electronic records may be delivered through Email, SMS, Mobile Application, Push Notifications, Customer Dashboard, Secure Online Portal, and In-App Messaging.
You are responsible for monitoring these communication channels.
5. Hardware and Software Requirements
To access electronic records, you must have Internet access, a supported web browser, a valid email address, a smartphone, tablet, or computer, and the ability to download or view PDF documents.
You are responsible for maintaining the necessary hardware and software.
6. Record Retention
You may save or print copies of electronic records for your own records. Qistiq may retain electronic records including agreements, signatures, timestamps, audit logs, payment authorizations, and repayment records.
Records are retained for compliance, operational, legal, and fraud prevention purposes.
7. Electronic Signature Evidence
Qistiq may store information associated with your electronic signature, including full legal name, timestamp, date and time signed, IP address, device information, browser information, user account information, agreement version, Advance ID, and payment authorization details.
These records may be used as evidence of acceptance and authorization.
8. Withdrawing Consent
You may request to withdraw your consent to receive electronic records by contacting Qistiq. However, withdrawal may limit access to certain services, affect your ability to receive future advances, and does not invalidate existing agreements and obligations.
Qistiq may require account closure if electronic communication is necessary to provide services.
9. Updating Contact Information
You agree to maintain current email address, phone number, mailing address, and account information.
Failure to maintain accurate contact information may affect your ability to receive important notices.
10. Communication Failures
Qistiq is not responsible for failure to receive communications caused by invalid email addresses, full inboxes, spam filtering, network outages, device issues, or incorrect contact information.
You remain responsible for reviewing account information and obligations.
11. Legal Effect
You acknowledge that electronic records have the same legal effect as paper records, electronic signatures have the same legal effect as handwritten signatures, electronic acceptance creates legally binding obligations, and electronic agreements may be used as evidence in legal proceedings where permitted by law.
12. Future Electronic Agreements
This Consent applies to future agreements, disclosures, notices, and records unless revoked in accordance with applicable law. Qistiq may update electronic communication methods and technologies as needed.
13. Governing Law
This Consent shall be governed by applicable laws and regulations in the jurisdiction where services are provided. Customers located in the United States and Egypt acknowledge that local legal requirements may apply.
