Qistiq Advance Late Payment Policy

This Late Payment Policy describes how Qistiq Advance handles missed or overdue payments related to cash advances provided through the Qistiq platform.
1. Purpose
The purpose of this Policy is to:

- •Provide transparency regarding overdue accounts.
- •Explain the consequences of late payments.
- •Establish fair and consistent account management procedures.
- •Comply with applicable laws and regulations.
2. Payment Due Date
The repayment due date will be clearly displayed before you accept a cash advance. You are responsible for ensuring that repayment is completed on or before the due date. Your repayment obligation remains valid regardless of app deletion, account closure requests, device replacement, email changes, phone number changes, or changes in employment status.
3. Payment Status Definitions
Current: The repayment due date has not yet arrived. Due Today: The repayment is scheduled for today. Past Due: Payment was not received on the due date. Delinquent: Payment remains unpaid after multiple reminder attempts. Collections Review: The account has been transferred for collections review. Legal Review: The account has been escalated for legal evaluation where permitted by applicable law.
4. Reminder Schedule
Qistiq may send repayment reminders through Email, SMS, Push Notifications, In-App Notifications, and Customer Support Outreach. Reminders are sent 7 days, 3 days, and 1 day prior to the due date, on the due date, and 1, 3, 7, 14, and 30 days after the due date.
Additional reminders may be sent where permitted by law.
5. Failed Payment Attempts
If a payment attempt fails, Qistiq may:
- •Notify you immediately.
- •Request updated payment information.
- •Retry authorized payment methods where legally permitted.
- •Contact you regarding repayment arrangements.
You remain responsible for repayment even if a payment attempt fails.
6. Account Restrictions
Overdue accounts may be subject to:
- •Suspension of new advance requests.
- •Reduction of available limits.
- •Removal of premium features.
- •Temporary account restrictions.
- •Additional verification requirements.
Future eligibility may be negatively affected by late payments.
7. Internal Risk Impact
Late payments may affect Qistiq Risk Score, Financial Health Score, Trust Score, future advance approvals, future advance limits, and premium membership eligibility.
Repeated late payments may result in increased account risk classifications.
8. Repayment Assistance
Customers experiencing financial hardship should contact Qistiq before the repayment date whenever possible. Qistiq may, at its sole discretion, review individual circumstances, consider repayment arrangements, and provide available assistance options.
Any accommodation is voluntary and does not waive repayment obligations.
9. Delinquent Accounts
Accounts may be classified as delinquent when payment remains outstanding beyond the due date. Factors considered may include length of delinquency, account history, communication history, repayment history, and fraud indicators.
Delinquent accounts may be referred for collections review.
10. Collection Activities
If payment remains outstanding, Qistiq may initiate collection activities where permitted by applicable law, including email and SMS communications, push notifications, telephone communications, internal collections efforts, and external collection agencies where legally permitted.
All collection efforts will be conducted in accordance with applicable laws and regulations.
11. Legal Review
Accounts with prolonged non-payment may be reviewed for potential legal action where permitted by applicable law.
Nothing in this Policy obligates Qistiq to pursue legal action.
12. Fraud and Intentional Non-Payment
Accounts involving identity fraud, false information, fake documents, payment fraud, or intentional misuse of services may be subject to immediate account suspension, internal investigation, reporting to appropriate authorities where permitted by law, and legal action where permitted by law.
13. No Waiver of Rights
Failure by Qistiq to immediately enforce any right under this Policy shall not constitute a waiver of such rights. Acceptance of partial payments does not waive any remaining repayment obligations unless expressly agreed in writing.
14. Policy Changes
Qistiq may update this Policy from time to time. Any updates become effective upon publication or notification as permitted by applicable law.
